1. General Provisions
1a. These conditions govern the remote purchase via the internet of products available on the site www.parmakit.com, hereinafter also referred to as the Site, owned by Parmakit s.r.l. Strada Antolini, 18/C – 43044 Lemignano di Collecchio, Parma, VAT number 02011740343, registered with the Parma Business Register REA PR203849.
2. Acceptance of the General Terms of Sale and Conclusion of the Contract
2a. Sending the order, made through the site www.parmakit.com or via email, constitutes the conclusion of the sales contract between the Site and the Customer, a declaration by the Customer of having read all the indications provided during the purchase procedure and acceptance of these terms of sale in their entirety.
3. Prices
3a. All product prices indicated on www.parmakit.com are expressed in Euros, excluding VAT and already discounted.
3b. Shipping costs are not included in the purchase price.
3c. Prices may be changed at any time without notice.
3d. In case of a computer, manual, technical, or any other type of error that results in a substantial change in the sale price, not foreseen by the Site, such as to be exorbitant or negligible, any purchase order concluded by the Customer will be considered invalid and canceled, and the amount paid will be refunded.
4. Product Availability
4a. The products on the Site are considered available at the time the Customer places the order. However, this availability should be considered purely indicative.
4b. If the Customer wishes to purchase a larger quantity of a product and it is available on the site in smaller units, it is recommended to contact via email to proceed with the request.
4c. The photo on the product sheet is purely illustrative, as it may vary in size, colors, and related accessories.
5. Purchase Methods
5a. The Customer can place the order through the site or via email.
5b. Following the purchase, the Customer will receive an automatic email confirming receipt of the same. The order will be processed as quickly as possible, followed by a confirmation email and shipment notification, including the tracking number provided by the courier to monitor its status.
5c. If the Customer wishes to modify their order (e.g., add other items) or the provided data (e.g., shipping address), they must communicate it as quickly as possible, strictly before shipment, through any available means of communication, ensuring to obtain confirmation of receipt of the communication from www.parmakit.com
5d. The Site reserves the right to cancel in whole or in part or to defer an order received due to force majeure related to the supply of material, without previous communications of order acceptance constituting confirmation or obligations, excluding any type of damage compensation against www.parmakit.com
5e. No responsibility is attributable to the Site in case of delay in order fulfillment.
5f. The invoice can only be requested at the time of order completion, it will be compiled with the data provided by the Customer during the purchase procedure and cannot be modified after its issuance. The minimum amount for issuing the invoice to VAT holders is €40.00 + VAT.
6. Payment Methods
6a. Payment can be made according to the listed methods. Any other type of payment must be agreed upon in advance.
Credit cards: Major credit cards are accepted. Payment is made immediately upon sending the order.
PayPal: An account is required, following registration on the PayPal site, to which your credit card or bank account is linked. Payment is made immediately upon sending the order.
Bank transfer: Payment must be made at the same time as sending the order or in any case no later than 24 hours from it, by making a bank transfer to the IBAN of www.parmakit.com which will be communicated at the time of sending the order, entering the order number in the reason. Receipt of payment is not immediate, as it may take several days before the transfer is completed. Because of this, this type of payment will require a longer processing time. The Site undertakes to process the order as soon as the bank transfer is visible.
7. Delivery Methods
7a. The delivery of orders placed on the Site is carried out by couriers selected based on the destination indicated by the Customer at the time of the order.
7b. It will be possible to track the package through the tracking number provided by the courier and communicated via email by www.parmakit.com or directly by the courier in conjunction with the shipment confirmation.
7c. It is possible to request insured shipping, the cost of which varies based on the value of the goods. The Customer is requested to make such a request before placing the order.
7d. The goods are always shipped accompanied by a receipt/invoice.
7e. No responsibility is attributable to www.parmakit.com for the delay or failure to deliver the goods.
7f. The goods are shipped freight prepaid, and the risk remains with www.parmakit.com until the Customer or a third party delegated by them, other than the carrier, acquires physical possession of the goods. The Customer is requested at the time of delivery to verify the integrity and number of packages. If they are not intact or appear tampered with, the Customer must immediately contest them to the courier, collecting them with reservation. In this case, the Customer undertakes to draw up, before collection and in the presence of the carrier, a document of acceptance with reservation of any irregularities found. Once the packages are collected, the Customer is required to verify the qualitative and quantitative correspondence of the goods with respect to what was ordered. In case of discrepancies, the Customer is requested to communicate it in writing within seven days to www.parmakit.com
7g. Shipments that are not collected or that return to the sender without prior authorization from the Site will still be charged to the Customer.
7h. The Customer waives the right to raise any kind of exception without having promptly and correctly fulfilled each of their obligations.
8. Shipping Costs
8a. Shipping costs are borne by the Customer and adequately highlighted at the time of order completion.
8b. Customers intending to place orders with delivery outside the Italian territory are requested to contact www.parmakit.com in advance to request the amount of the aforementioned shipping costs.
9. Order Cancellation
9a. The Customer can cancel their order before it is shipped, promptly sending an email to info@parmakit.com with the subject “Order Cancellation n.” in which they will communicate the will to cancel and the order number.
9b. The cancellation is considered effective following an affirmative response confirming receipt of the previous email from www.parmakit.com
9c. If the conditions for the cancellation procedure are met, the Customer will be immediately refunded the amount paid with the order.
9d. If the communication of the will to cancel the order is received by the Site after the shipment has been made, the Customer can exercise the right of withdrawal once the goods are received.
9e. If the Customer requests cancellation of the order after the shipment has been made, the Customer will be charged the costs of the first shipment, a flat fee of €20.00 covering the management of the order following contractual non-fulfillment, in addition to the shipping costs to return the goods to www.parmakit.com, which will be borne by the Customer.
10. Right of Withdrawal
10a. According to current regulations, the Customer has the right to withdraw from the purchase without penalty and without having to specify the reason within 14 days from the date of receipt of the products ordered on wwww.parmakit.com
10b. This right is intended for final consumers, natural persons who make purchases for purposes unrelated to their commercial activity or who do not provide the VAT number at the time of the order. It does not apply to professional consumers who purchase for purposes related to their professional activity or with a VAT number.
10c. The right of withdrawal applies to unused products, in their original packaging, and may concern the entire order or part of it. Goods ordered at the Customer’s request and exhausts are not included among the goods subject to the right of withdrawal. For any doubts, it is advisable to ask for more information before purchasing.
10d. To exercise the right of withdrawal, it is necessary to submit a written request by sending an email to info@parmakit.com with the subject “Withdrawal order n.”, indicating the order number, and send the goods to be returned in their original packaging, including all its elements, accompanied by a receipt/invoice and a copy of the email sent or a sheet with the transcription of the same indicating the will to withdraw, taking particular care to pack the products carefully to avoid any damage. Return shipments without one of these elements will not be eligible for the exercise of the right of withdrawal. The shipping costs to return the goods following withdrawal are borne by the Customer. Cash on delivery shipments or in any case with costs borne by the Site will not be accepted. The shipment must be made by the Customer within 14 days from the date of sending the email for the exercise of the right of withdrawal.
10e. Following the return of the products, after due checks, if there are grounds to proceed, the Customer will receive a refund of the price paid for the purchase of the goods, excluding shipping costs, through the same payment method used or another agreed upon, as soon as possible and in any case no later than 14 days from the receipt of the goods at the headquarters of www.parmakit.com
10f. If the returned goods are not accompanied by the required documents (receipt/invoice and copy of the email), are not complete in all their parts, elements, manuals, labels, or packaging, or are used or manipulated, it will not be possible to proceed with the normal and complete withdrawal procedure and the related refund. In particular, the Customer is responsible for the decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics, and functioning, according to Directive 2011/83/EU co. 47 which provides that “the consumer should only handle and inspect them in the same way as they would be allowed to do in a store”.
11. Customer Service for Info and Complaints
11a. The Customer can receive assistance and answers to their questions at any time during every phase of the purchase process, before, during, and after, by sending an email to info@parmakit.com
11b. In case of complaints that do not fall within the desire to cancel the order or exercise the right of withdrawal, the Customer can write to info@parmakit.com
12. Limitation of Liability
12a. Parmakit s.r.l. is committed to ensuring the best possible update of the site and the accuracy of the information contained therein. However, it does not exclude the possibility of publication errors and inaccuracies in texts, prices, and images. The Customer agrees to fully waive the responsibility of Parmakit s.r.l. regarding this type of error that may cause reliance on possibly incorrect information contained on the site.
12b. Parmakit s.r.l. reserves the right to modify the site and its contents in any part at any time without the obligation of prior or subsequent communication.
12c. Parmakit s.r.l. disclaims any liability for direct, indirect, or consequential damages or losses, including delays, lost profits, or loss of other economic advantage, connected or arising from the use of the site or the information contained therein, excluding the possibility for the Customer to pursue any type of compensation action related to such reasons.
12d. Parmakit s.r.l. is not responsible for any direct or indirect damage resulting from the sale of the goods offered, nor for the delay or failure to deliver them or for the correspondence of the goods with the description on the site.
12e. Parmakit s.r.l. is not responsible for direct or indirect damages, accidents, injuries, or deaths occurring during the use of the goods sold through the site.
12f. Parmakit s.r.l. is not responsible for the use of the goods sold on the site not in accordance with what is indicated in the manufacturer’s manual.
12g. Parmakit s.r.l. is not responsible for compatibility errors between the sold goods and the Customer’s vehicle model if the error derives from the catalog or the manufacturer’s website, from which the information for the descriptions of the products sold on the Site is taken.
12h. Some goods for sale on the Site are not intended for use on public roads, but only for sporting events on tracks or circuits and trade fairs. Parmakit s.r.l. disclaims any type of use of these goods by the Customer not in accordance with the regulations. Goods intended for road use are indicated as homologated.
13. Legal and Conventional Warranties and Warranty Limitations
13a. All products sold on the Site are covered by a legal warranty for conformity defects on new products lasting 24 months and by the manufacturer’s conventional warranty. To benefit from the warranty, the Customer must keep the invoice/receipt received with the product. Requests will not be accepted if the Customer does not have the invoice/receipt for the purchase of the item.
13b. If the Customer finds a conformity defect on a newly purchased product on the Site, they must immediately notify by sending an email to info@parmakit.com with the subject “Order Warranty No.”, indicating the order number, attaching the receipt/invoice and any photos showing the product defect. The Customer will receive an email notification of the start of the preliminary verification phase and, if the requirements for the replacement of the item are met, will be invited to send the product, complete in all its parts, accessories, and manuals, in the original packaging, along with the receipt/invoice, at their own expense to the headquarters of www.parmakit.com to proceed with verifying the defect, carried out through a technical check by www.parmakit.com or the Manufacturer or an Authorized Service Center. Once the product is received and examined, if the manufacturing defect is confirmed, it will be repaired or replaced free of charge, as soon as possible, and sent back to the Customer, with shipping costs covered by www.parmakit.com. In the event that, following the verification by Parmakit s.r.l. or the Manufacturer, no conformity defect is found, any verification, restoration, or transport costs incurred by Parmakit s.r.l. will be charged to the Customer.
13c. Legal warranty for Consumer Customers: The Individual who purchases goods on the Site for purposes not related to their professional activity or makes the purchase without indicating their VAT number at the time of order is entitled to the legal warranty provided in case of a manufacturing defect of the purchased item, making a request within 24 months from the purchase date shown on the invoice/receipt. This warranty applies for conformity defects, provided the item is used correctly, respecting its intended use and the instructions in the technical manual, has been correctly installed, and no assistance, maintenance, or repairs have been carried out by Technicians not authorized by the Site.
13d. Legal warranty for Professional Customers: The Professional Customer who makes a purchase for their business activity by entering the VAT number at the time of purchase is entitled to the legal warranty for conformity defects on new products within 12 months of purchase.
13e. Manufacturer’s conventional warranty: To know the specific additional warranties provided by the individual Manufacturer of the item purchased on Parmakit s.r.l., it is necessary to consult the Manufacturer’s site directly or the Manufacturer’s documentation accompanying the item.
13f. Warranty Limitations: The warranty for manufacturing defects applies only to new products that have been used/installed correctly, respecting their intended use and according to the methods provided in the Manufacturer’s technical documentation. The warranty does not apply if the defect is a result of negligence, incorrect or non-compliant use or installation according to the indications in the Manufacturer’s technical documentation, mistreatment, or deterioration resulting from misuse or storage, as well as resulting from weather conditions, insufficient or irregular power supply, product modifications. Product installation must be carried out by specialized professional personnel in the sector. Any technical intervention carried out without the authorization of Parmakit s.r.l. automatically voids the right to restore/replace the item under warranty. All perishable products with use for which it is not possible to establish with certainty the cause of the malfunction because it is linked to external factors are not covered by warranty. Batteries are included in this warranty limitation. To prevent batteries from undergoing an irreversible deterioration process not covered by warranty, it is mandatory that they are maintained with a charge above 12V after being installed on the vehicle and if the vehicle is not used for an extended period. In these cases, only the Manufacturer’s warranty applies.
13g. Goods that, after being examined, are not eligible for warranty coverage will be returned to the Customer at their expense, including the return shipping costs and any additional transport costs incurred by www.parmakit.com for verification and restoration.
13h. If it is not possible to restore or replace a product covered by warranty for any reason,
13i. The terms for requesting warranty assistance are strict.
13l. Parmakit s.r.l. is not responsible for any type of damage resulting from delays in carrying out repairs or replacements of goods under warranty.
14. Applicable Law and Jurisdiction
14a. The online sales contract is considered concluded in Italy and is governed by Italian Law.
14b. For the resolution of civil disputes arising from the conclusion of the distance sales contract, the territorially competent court is the judge of the place of residence or domicile of the consumer, if located in Italian territory.
